How Scaffolding Accidents Happen

OSHA Subpart L, the federal construction standard governing scaffolds, addresses design, load capacity, access, training, and fall protection. Scaffolds and their components generally must support their own weight plus at least four times the maximum intended load. Workers more than 10 feet above a lower level also require appropriate fall protection.

  • Falls from platforms: Missing guardrails, incomplete planking, unsafe access, or inadequate personal fall-arrest systems can expose workers to elevated falls.
  • Scaffold collapses: Improper assembly, unstable supports, overloaded platforms, or damaged components can cause part or all of the structure to give way.
  • Falling object injuries: Tools, materials, and debris can strike workers or people below. Toe boards, screens, barricades, or other safeguards may be required when falling objects present a hazard.
  • Electrical contact: Metal scaffolding erected too close to energized power lines can put workers at risk of electrocution.

These incidents can cause traumatic brain injuries, spinal cord injuries, fractures, and other serious harm. A prompt investigation is important because scaffold components may be removed, reused, repaired, or discarded as construction continues.

Who May Be Liable Beyond the Employer

Workers’ compensation is generally an employee’s exclusive remedy against an employer. This means an employee usually can’t file a separate negligence lawsuit against that employer for the same workplace injury. The restriction doesn’t automatically protect a negligent third party.

A third-party claim may involve a general contractor that controlled a hazardous condition, a subcontractor that erected the scaffold, a property owner responsible for unsafe premises, or a manufacturer connected to a defective component. Contracts, site-control records, inspection documents, photographs, witness accounts, and equipment evidence can reveal who owed a legal duty and whether that duty was violated.

Georgia follows modified comparative negligence in personal injury cases. Someone found less than 50% responsible may recover damages reduced by their percentage of fault. A person assigned 50% or more of the fault generally can’t recover through a negligence claim.

How Workers’ Compensation & Third-Party Claims Work Together

Workers’ compensation generally covers authorized medical treatment and partial wage replacement without requiring proof that the employer caused the accident. However, it doesn’t compensate an injured employee for pain and suffering or necessarily replace all lost income.

A third-party personal injury claim is a separate action against a non-employer whose negligence contributed to the injury. It can proceed alongside workers’ compensation and may provide compensation for losses unavailable through workplace benefits, including pain and suffering and additional lost earnings, when supported by the evidence.

Important Georgia deadlines and coordination issues include:

  • Employer notice: An injured worker generally must notify the employer within 30 days of the accident.
  • Workers’ compensation filing: A claim generally must be filed within one year, although the facts and statutory exceptions can affect the deadline.
  • Personal injury filing: Georgia’s statute of limitations generally allows two years from the injury date to file a negligence lawsuit.
  • Insurance reimbursement: A workers’ compensation insurer may assert a subrogation lien, which is a claimed right to reimbursement from a third-party recovery. Whether and how the lien applies depends on Georgia law and the compensation obtained.
